PURPOSE<br \/>Nicholls State University is committed to providing a safe and healthy environment for students, faculty, staff, and visitors. This policy is designed to maintain a smoke-free learning and working environment, decrease exposure to secondhand smoke and aerosols, and comply with\u00a0 Louisiana Act 211 (LA R.S. 40:1293.3).<\/p><p>II. DEFINITIONS<\/p><p>\u25cf Electronic Smoking Device: Any product containing or delivering nicotine or any other substance intended for human consumption that can be used by a person in any manner for the purpose of inhaling vapor or aerosol from the product. This includes, but is not limited to, e-cigarettes, e-cigars, e-pipes, e-hookahs, dab rigs, vape pens, or JUULs.<br \/>\u25cf Smoking: Inhaling, exhaling, burning, or carrying any lighted or heated cigar, cigarette, pipe, hookah, or any other lighted or heated tobacco or plant product intended for<br \/>inhalation, whether natural or synthetic, including marijuana\/cannabis. This includes the use of an Electronic Smoking Device, which creates an aerosol or vapor.<br \/>\u25cf Tobacco Product: Any substance containing tobacco leaf, including but not limited to cigarettes, cigars, pipe tobacco, hookah tobacco, snuff, chewing tobacco, dipping<br \/>tobacco, bidis, blunts, clove cigarettes, or any other preparation of tobacco.<\/p><p>III. POLICY STATEMENT<\/p><p>The use of any Tobacco Product, Electronic Smoking Device, or Smoking (as defined above) is prohibited at all times on all Nicholls State University properties.<\/p><p>A. Applicability<br \/>This policy applies to all students, faculty, staff, contractors, vendors, and visitors. It covers:<br \/>1. All interior spaces on the main campus and satellite locations (Chauvin Garden, etc.).<br \/>2. All outside property, grounds, sidewalks, lawns, and recreational fields.<br \/>3. All university-owned, leased, or operated vehicles.<br \/>4. All personal vehicles while parked on university property.<br \/>5. All indoor and outdoor athletic facilities.<\/p><p>B. Marijuana and Cannabis<br \/>In compliance with the Federal Drug-Free Schools and Communities Act, the use, possession,\u00a0 or distribution of marijuana or cannabis products\u2014including medical marijuana\u2014is strictly prohibited on all university property. While Louisiana state law may permit medical use under certain conditions, federal law requires Nicholls to prohibit it in all forms to maintain eligibility for federal funding.<\/p><p>For more information on the university\u2019s commitment to a safe and drug-free environment, please refer to the Nicholls State University Alcohol and Other Drug (AOD) Policy.<\/p><p>C. Promotion and Sales<br \/>The sale, sampling, or advertisement of tobacco or nicotine products (including logo-containing merchandise) is prohibited on campus, regardless of the operating vendor. The university may accept funding from tobacco, vaping, or other nicotine-product companies only to support independent educational efforts that inform students about the health risks of these products. The university will maintain full control over all educational content, and such funding may not<br \/>be used for product promotion or marketing.<\/p><p>IV. PROCEDURE<\/p><p>A. General Education and Awareness<br \/>Implementation will be supported by an ongoing campaign, including:<br \/>\u25cf Inclusion in Student and Faculty\/Staff Policy &amp; Procedure Manuals<br \/>\u25cf Notification to prospective students and new hires during orientation.<br \/>\u25cf Signed awareness statements for all new employees.<br \/>\u25cf Signage at all vehicular and pedestrian entrances and \u201cTobacco-Free Facility\u201d decals on all buildings.<br \/>\u25cf Inclusion in all university contracts, including those for vendors, independent contractors, and construction firms.<br \/>\u25cf Inclusion in all facility reservation documents and agreements for outside entities<\/p><p>B. Tobacco Use Cessation Programs<br \/>The university supports members of the community who wish to quit.<br \/>\u25cf Students: Contact University Health Services for information on medications and cessation resources.<br \/>\u25cf Employees: Contact Human Resources for information regarding the Employee Assistance Program (EAP) and local cessation services.<\/p><p>C. Compliance and Enforcement<br \/>Compliance is the responsibility of all members of the Nicholls community.<\/p><p>1. Reporting: Violations should be reported to the appropriate supervisor, the Dean of Students (for students), or Human Resources (for employees). University Police and<br \/>Environmental Health and Safety provide additional support.<\/p><p>2. Sanctions:<br \/>\u25cb Students: Handled by the Dean of Students. Sanctions may range from verbal warnings to dismissal\/expulsion.<br \/>\u25cb Employees: Handled by Human Resources. Sanctions may include verbal warnings, written documentation, or termination proceedings.<\/p><p>V.
