Appeal Process

Should the student defendant wish to appeal the decision of the Dean of Students, a letter must be written to the Chairperson of the Discipline Committee within ten (10) days of the decision.  The validity of the appeal will be determined by the Chairperson of the Discipline Committee.  If the appeal is valid it will be considered by the Discipline Committee.  The appeal letter must indicate the basis from one of the following:

  1. Published procedures were not followed.
  2. There was insufficient evidence to support the charge.
  3. Sanction(s) imposed were inappropriate.
  4. Subsequent to the hearing, information was discovered which indicates that member(s) of the committee were not impartial (Discipline Hearing).
  5. No new evidence may be presented.

Retaliatory action by any party involved is subject to disciplinary action.

The Discipline Committee Chair will review the documentation regarding the case and will provide
a decision about the appeal. As the appeals process is written, the Chair will contact the student with any specific questions. 

The Discipline Committee Chair has the following options available to him/her:

  1. Deny the Appeal and uphold the original decision based on not satisfying the Appeal Criteria.
  2. Accept the Appeal based on satisfying the Appeal Criteria and send the case back for a new case resolution.
  3. Accept the Appeal based on satisfying the Appeal Criteria and schedule a meeting with the full Discipline Committee.

The student should expect to hear a decision regarding the appeal, or an update regarding the process, within 5 business days.
