class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3><b>Introduction<\/b><\/h3><p>\u00a0<\/p><p><span style=\"font-weight: 400\">Students at Nicholls are expected to be partners in the process of fulfilling the mission of the University by creating and maintaining standards within student groups, teams, and organizations that are conducive to personal growth and development.\u00a0 If student groups, teams, or organizations are to play an integral role in the University\u2019s plan, they must set standards that challenge each individual to achieve his or her greatest potential.\u00a0 Hazing is the antithesis of this goal, in that it attempts to tear down the feelings of personal pride and self-esteem of the individual, under the guise of creating some solidarity in the group.\u00a0\u00a0<\/span><\/p><p>\u00a0<\/p><h4><b>Policy<\/b><\/h4><p>\u00a0<\/p><p><span style=\"font-weight: 400\">Nicholls State University adheres to the:\u00a0 <\/span><a href=\"https:\/\/www.ulsystem.edu\/wp-content\/uploads\/2019\/08\/UL-SYSTEM-Revised-Hazing-Policy-2019_.pdf\"><span style=\"font-weight: 400\">University of Louisiana System Policy (Effective: 8\/27\/2019)<\/span><\/a><span style=\"font-weight: 400\">,\u00a0 The <\/span><a href=\"https:\/\/www.laregents.edu\/wp-content\/uploads\/2019\/10\/BoR-Hazing-Information-Policy-FINAL-APPROVED-8-28-19.pdf\"><span style=\"font-weight: 400\">Louisiana Board of Regents Uniform Policy on Public Information on Hazing Prevention<\/span><\/a><span style=\"font-weight: 400\"> (effective 8\/28\/2019), and upholds all Louisiana statutes related to hazing.\u00a0 The University prohibits any form of hazing.\u00a0 Student organizations and\/or individual members found to have engaged in hazing shall be in violation of the Nicholls State University Standards of Conduct and <\/span><a href=\"https:\/\/legis.la.gov\/legis\/Law.aspx?d=1106699\"><span style=\"font-weight: 400\">Louisiana Statute R.S. 14:40.8<\/span><\/a><span style=\"font-weight: 400\"> and are punishable by a fine and\/or imprisonment as well as by dismissal from the University.\u00a0\u00a0\u00a0<\/span><\/p><p>\u00a0<\/p><h4><b>Purpose<\/b><\/h4><p>\u00a0<\/p><ol><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Maintain a safe learning environment that is free from hazing.\u00a0 Hazing activities of any type are inconsistent with the educational goals of Nicholls State University and Louisiana Law and are prohibited at all times.\u00a0 No student, faculty or staff member, employee, administrator, guest, contractor, or volunteer shall plan, direct, encourage, aid, or engage in hazing.\u00a0<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Assist with the prevention of hazing.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Encourage reporting, which is the responsibility of every member of the university community.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Accept the personal obligation to adhere to the basic community values of being civil and respectful of others.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Protect the safety and rights of all students.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Preserve the educational environment.<\/span><\/li><\/ol><h4>\u00a0<\/h4><h4><b>Definitions<\/b><\/h4><p>\u00a0<\/p><ol><li style=\"font-weight: 400\"><i><span style=\"font-weight: 400\">\u00a0<strong>Hazing <\/strong><\/span><\/i><span style=\"font-weight: 400\">is defined as any intentional, knowing or reckless act. Occurring on or off campus of an educational institution, by one person alone or acting with others, directed against an individual that endangers the mental or physical health of a student for the purpose of pledging, being initiated into, affiliating with, holding office in, or maintaining membership in any organization whose members are or include students at an educational institution, including but not limited to:<\/span><ul><li style=\"list-style-type: none\"><ul><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The person knew or should have known that such an act endangers the physical health or safety of the other person or causes severe emotional distress.\u00a0\u00a0<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The act was associated with pledging, being initiated into, affiliating with, participating in, holding office in, or maintaining membership in any organization.\u00a0<\/span><\/li><\/ul><\/li><\/ul><\/li><\/ol><p style=\"padding-left: 40px\"><span style=\"font-weight: 400\">Hazing includes and is not limited to any of the following acts associated with pledging, being initiated into, affiliating with, participating in, holding office in, or maintaining membership in any organization:<\/span><\/p><ul><li style=\"list-style-type: none\"><ul><li style=\"list-style-type: none\"><ul><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Physical brutality, such as whipping, beating, paddling, striking, branding, electric shocking, placing of harmful substances on the body, or similar activity.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Physical activity such as sleep deprivation, exposure to the elements, confinement in a small space, or calisthenics, that subjects the other person to an unreasonable risk of harm or that adversely affects the physical health or safety of the individual or causes severe emotional distress.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Activity involving consumption of food, liquid, or any other substance, including but not limited to, an alcoholic beverage or drug, that subjects the individual to an unreasonable risk of harm that adversely affects the physical health or safety of the individual or causes severe emotional distress.\u00a0\u00a0<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Activity that indices, causes, or requires an individual to perform a duty or task that involves the commission of a crime or an act of hazing.<\/span><\/li><\/ul><\/li><\/ul><\/li><\/ul><p style=\"padding-left: 40px\"><span style=\"font-weight: 400\">It is important to note that physical activity that is normal, customary, and necessary for a person\u2019s training and participation in an athletic, physical education, military training, or similar program sanctioned by the postsecondary education institution is not considered \u201chazing.\u201d<\/span><\/p><p>\u00a0<\/p><p style=\"padding-left: 40px\"><i><span style=\"font-weight: 400\">2.\u00a0 <strong>Organization<\/strong><\/span><\/i><span style=\"font-weight: 400\"> is a fraternity, sorority, association, corporation, order, society, corps, cooperative, club, service group, social group, band, spirit group, athletic team, or similar group whose members are primarily students at, or former students of, a postsecondary education institution, including the national or parent organization of which an of the underlying entities provided for in this definition is a sanctioned or recognized member at the time of the hazing.\u00a0\u00a0<\/span><\/p><p>\u00a0<\/p><p style=\"padding-left: 40px\"><i><span style=\"font-weight: 400\">3. <strong>Pledging <\/strong><\/span><\/i><span style=\"font-weight: 400\">is any action or activity related to becoming a member of an organization, including recruitment and rushing.<\/span><\/p><p>\u00a0<\/p><p style=\"padding-left: 40px\"><i><span style=\"font-weight: 400\">4. <strong>Appropriate Authority\u00a0<\/strong><\/span><\/i><\/p><ol><li style=\"list-style-type: none\"><ul><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Any state or local law enforcement agency.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">A 911 Public Safety Answering Point as defined in Title 33 of the Louisiana Revised Statutes of 1950.\u00a0<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Emergency medical personnel.<\/span><\/li><\/ul><\/li><\/ol><p style=\"padding-left: 40px\"><i><span style=\"font-weight: 400\">5. <strong>Reckless Behavior <\/strong><\/span><\/i><span style=\"font-weight: 400\">is an activity or behavior in which a reasonable person knew or reasonably should have known that the activity or behavior may result in injury to another, including but not limited to, excessive consumption of alcohol, binge drinking, drag racing, consumption of any controlled dangerous substance, acts of hazing, or other similar activity.<\/span><\/p><p>\u00a0<\/p><p style=\"padding-left: 40px\"><i><span style=\"font-weight: 400\">6. <strong>Serious Bodily Injury<\/strong><\/span><\/i><span style=\"font-weight: 400\"> is bodily injury that involves unconsciousness, extreme physical pain, or protracted and obvious disfigurement, or protracted loss or impairment of the function of a bodily member, organ, or mental faculty, death, or a substantial risk of death.<\/span><\/p><p>\u00a0<\/p><p>\u00a0<\/p><h4><b>Reporting Requirement<\/b><\/h4><p>\u00a0<\/p><p><span style=\"font-weight: 400\">In accordance with\u00a0 <\/span><a href=\"https:\/\/www.laregents.edu\/wp-content\/uploads\/2019\/07\/ACT-382.pdf\"><span style=\"font-weight: 400\">R.S. 14:40.8(B) and R.S. 17:1801(C), 1801.1(C), and 1805(A)(3), 3 (B), and (D)(2) and to enact R.S. 17:1801.1(B)(3)<\/span><\/a><\/p><p>\u00a0<\/p><ol><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">\u00a0The Board of Regents, in consultation with the public postsecondary education management boards, shall develop the following:\u00a0\u00a0\u00a0<\/span><\/li><\/ol><ul><li style=\"list-style-type: none\"><ul><li style=\"list-style-type: none\"><ul><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">A <\/span><a href=\"https:\/\/www.nicholls.edu\/greek\/wp-content\/uploads\/sites\/99\/2021\/11\/BoR-Standardrized-HAZING-Form-for-Organizations-8-5-2019-fillable.pdf\"><span style=\"font-weight: 400\">BOR Standardized Form for Organizations<\/span><\/a><span style=\"font-weight: 400\"> that organizations shall use in making the reports required.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">A BOR Standardized Form for Institutions that institutions shall use to document such reports, reports made to law enforcement as provided in R.S. 14:40.8, and the manner in which each hazing incident is handled and resolved at the institutional level.<\/span><\/li><\/ul><\/li><\/ul><\/li><\/ul><p style=\"padding-left: 40px\"><span style=\"font-weight: 400\">2.<\/span><span style=\"font-weight: 400\">\u00a0It shall be the duty of all current and potential student organization members, officers, including any representative, director, trustee, or officer of any national or parent organization of to report as soon as practicable under the circumstances, to the Dean of Students and to law enforcement that one or more members of the organization were hazing another member.\u00a0 An educational institution that receives a report alleging the commission of an act or acts of hazing by one or more members of an organization that is organized and operating at the educational institution:<\/span><\/p><ul><li style=\"list-style-type: none\"><ul><li style=\"list-style-type: none\"><ul><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Shall report, as soon as practical under the circumstances, the alleged act or acts to the law enforcement agency having jurisdiction in the place where the alleged act or acts of hazing occurred.\u00a0 The information reported to law enforcement shall include all details received by the institution relative to the alleged incident, with no information being redacted, including the name of all individuals alleged to have committed the act of acts of hazing.\u00a0\u00a0<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Document in writing all actions taken with regards to the report, including but not limited to the date the report was received, reports made to law enforcement as provided in R.S. 14:40.8, and any other information relative to the institution\u2019s investigation process and resolution of the incident any education institution who fails to comply with the provisions of this paragraph may be subject to a fine up to ten thousand dollars.\u00a0 R.S. 17:1801(C)<\/span><\/li><\/ul><\/li><\/ul><\/li><\/ul><p style=\"padding-left: 40px\"><span style=\"font-weight: 400\">3. <\/span><span style=\"font-weight: 400\">U.S. Stop Campus Hazing Act amends section 485(f) of the Higher Education Act (also known as the Clery Act) to require institutions to<\/span><\/p><ul><li style=\"list-style-type: none\"><ul><li style=\"list-style-type: none\"><ul><li><span style=\"font-weight: 400\">Include hazing statistics in annual security reports<\/span><\/li><li><span style=\"font-weight: 400\">Implement hazing policies about how to report hazing<\/span><\/li><li><span style=\"font-weight: 400\">Compile and publish on their public website a hazing transparency report that summarizes findings concerning any organization found in violation of hazing standards<\/span><\/li><\/ul><\/li><\/ul><\/li><\/ul><h4><b>Duty to Seek Assistance<\/b><span style=\"font-weight: 400\">\u00a0<\/span><\/h4><p>\u00a0<\/p><p><span style=\"font-weight: 400\">In accordance with Act 637 of 208, codified at <\/span><a href=\"https:\/\/www.legis.la.gov\/legis\/Law.aspx?d=1106740\"><span style=\"font-weight: 400\">R.S. 14:502\u00a0<\/span><\/a><\/p><ol><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">\u00a0Any person at the scene of an emergency who knows that another person has suffered serious bodily injury shall, to the extent that the person can do so without danger or peril to self or others, give reasonable assistance to the injured person. Reasonable assistance includes immediately seeking or reporting the need for medical assistance from an appropriate authority.\u00a0<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Any person who engages in reckless behavior that results in the serious bodily injury of any person shall, to the extent that the person can do so without danger or peril to self or others, give reasonable assistance to the person. Reasonable assistance includes immediately seeking or reporting the need for medical assistance from an appropriate authority.\u00a0<\/span><\/li><\/ol><h4><b>Hazing Education<\/b><\/h4><p>\u00a0<\/p><p><span style=\"font-weight: 400\">Not later than August 1, 2018, the Board of Regents shall develop and adopt a uniform policy<\/span><a href=\"https:\/\/www.laregents.edu\/wp-content\/uploads\/2019\/10\/BoR-Hazing-Information-Policy-FINAL-APPROVED-8-28-19.pdf\"><span style=\"font-weight: 400\"> (BORUP)<\/span><\/a><span style=\"font-weight: 400\"> on hazing prevention. The policy shall define hazing as defined in R.S. 17:1801. Each postsecondary education institution shall adopt the uniform policy developed by the Board of Regents. An institution may expand the definition of hazing to prohibit additional behaviors it determines may be dangerous, but shall not otherwise amend the definition.<\/span><\/p><ol><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Each new student shall be provided educational information on the dangers of and prohibition on hazing during the new student orientation process in the form of a handbook.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Each new student shall be provided educational information on the dangers of and prohibition on hazing during the new student orientation process, either in person or electronically. UNIV 101, as the required orientation to the university life course, serves this purpose.\u00a0<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">If the student receiving the information required in this subsection is a minor, that information shall also be provided to their parent or legal guardian.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Each organization, as defined in R.S. 17:180.1, shall provide annually at least one hour of hazing prevention education to all members and prospective members. The education may be provided in person, electronically, or both. Each organization shall submit a report annually to the institution with which it is affiliated relative to the students receiving such education, evidenced by an attestation of the student receiving the education. (Note: Act 172 of the 2025 LaLeg session amends 17:1801.1(C) to require 2 hours of education for members of groups)<\/span><\/li><\/ol><h4><b>Sanctions<\/b><\/h4><ol><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Organizations and Affiliates\u00a0<\/span><ul><li style=\"list-style-type: none\"><ul><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">If an organization has taken disciplinary action against one of its members for hazing or has reason to believe that any member of the organization has participated in an incident of hazing, the organization shall report the incident as soon as practicable under the circumstances to law enforcement and the institution with which it is affiliated. The information shall be reported on the <\/span><a href=\"https:\/\/www.nicholls.edu\/greek\/wp-content\/uploads\/sites\/99\/2021\/11\/BoR-Standardrized-HAZING-Form-for-Organizations-8-5-2019-fillable.pdf\"><span style=\"font-weight: 400\">Hazing Reporting Form<\/span><\/a><span style=\"font-weight: 400\"> and shall include all details received by the institution relative to the alleged incident, with no information being redacted, including the name of all individuals alleged to have committed the act or acts of hazing.<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">If an organization or any of its members has been disciplined by a parent organization for hazing, the organization shall report the hazing for which the organization was disciplined to the institution with which it is affiliated.\u00a0<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">If any person serving as a representative or officer of an organization, including any representative, director, trustee, or officer of any national or parent organization of which any of the underlying entities as recognized in Section III B of this Policy is sanctioned or recognized member at the time of the hazing, knew and failed to report to law enforcement that one or more of the organization\u2019s members were hazing another person, the organization may be subject to penalties under <\/span><a href=\"https:\/\/www.legis.la.gov\/legis\/Law.aspx?d=1106699\"><span style=\"font-weight: 400\">R.S. 14:40.8.<\/span><\/a><span style=\"font-weight: 400\">\u00a0<\/span><\/li><\/ul><\/li><\/ul><\/li><li><span style=\"font-weight: 400\">\u00a0Students\u00a0<\/span><ul><li style=\"list-style-type: none\"><ul><li><span style=\"font-weight: 400\">Any student who violates the provisions of Acts 635, 637, and 640 of the 2018 Regular Session of the Louisiana Legislature and this Policy shall be expelled, suspended, or dismissed from the institution and not permitted to return for at least one semester, quarter, or comparable academic period and may be subject to criminal charges.\u00a0<\/span><\/li><li><span style=\"font-weight: 400\">Consent is not a defense. It is not a defense to prosecution of an offense that the person against whom the hazing was directed consented to or acquiesced in the hazing activity.\u00a0<\/span><\/li><li><span style=\"font-weight: 400\">Any student who fails to seek assistance as defined by the law and this Policy shall be subject to penalties outlined in <\/span><a href=\"https:\/\/www.legis.la.gov\/legis\/Law.aspx?d=1106699\"><span style=\"font-weight: 400\">R.S. 14:40.8.<\/span><\/a><b style=\"font-style: inherit\"><\/b><\/li><\/ul><\/li><\/ul><\/li><\/ol><p>\u00a0<\/p><h4><b style=\"font-style: inherit\">Amnesty<\/b><\/h4><p>\u00a0<\/p><p><span style=\"font-weight: 400\">Student health and safety are paramount concerns at all times, and Nicholls State University acknowledges that providing amnesty can facilitate students in promptly addressing medical emergencies. As outlined in the <\/span><a href=\"https:\/\/www.nicholls.edu\/student-policy\/institutional-authority\/\"><span style=\"font-weight: 400\">Student Policy and Procedure Manual,<\/span><\/a><span style=\"font-weight: 400\"> the university reserves the right to offer amnesty to students who report medical emergencies arising from incidents potentially involving policy violations. It is important to note that amnesty does not extend to actions that precipitated the incident. The discretion to grant amnesty rests with the Dean of Students and applies exclusively to breaches of the Student Policy and Procedure, distinct from any legal proceedings involving law enforcement<\/span><\/p><ul><li style=\"list-style-type: none\"><ul><li style=\"list-style-type: none\">\u00a0<\/li><\/ul><\/li><\/ul><h4><b>Campus Resources and
